Discrimination

Unfavourable treatment based on a ground prohibited by law, such as origin, sex, disability or religion, in an area covered by the law. It may involve employment, housing or access to a service, among other areas.

Recognising discrimination

Discrimination may be direct or result from an apparently neutral rule that puts certain people at a particular disadvantage, without a legally accepted justification.

Rejecting a job application because of the applicant’s origin may constitute discrimination. However, not every difference in treatment is automatically unlawful: the ground used, the area concerned and any justifications provided for by law must be examined.

Asserting your rights

A person who believes they have been a victim may keep relevant evidence and refer the matter to the Defender of Rights. Depending on the situation, they may also bring the matter before the competent court or file a complaint.
