Court of Cassation

The highest court in the French judicial system, with jurisdiction over civil and criminal matters. It reviews whether the courts whose decisions are referred to it have correctly applied the law, normally without re-examining the facts.

The highest court in the judicial system

The Court of Cassation sits at the top of the judicial system, which has jurisdiction notably over civil and criminal matters. Cases are brought before it by an appeal on points of law against a decision, under the conditions laid down by procedural rules.

Reviewing the law, not retrying the case

It normally checks that the rules of law have been correctly applied without re-examining the facts. If it finds an error that warrants quashing the decision, it may set the decision aside and refer the case to a court with jurisdiction.

Remember: this is not a third trial identical to those at first instance and on appeal. The Council of State plays a separate role in the administrative court system.
