Parental authority

The set of rights and duties parents have to serve the child’s best interests. It aims in particular to ensure the child’s protection, education and development, with respect for the child as an individual.

Protecting and supporting the child

Parental authority covers, in particular, the child’s safety, health, privacy, moral upbringing and education. It is exercised without physical or psychological violence. The child is involved in decisions affecting them according to their age and level of maturity.

After a separation

As a rule, the parents’ separation does not end the joint exercise of parental authority. Practical arrangements may be determined by agreement or by a judge, in the child’s best interests.

Not to be confused with

Parental authority is distinct from the child’s place of residence. Each parent must contribute to the child’s maintenance and education in accordance with the applicable rules.
